{"id":9469,"date":"2026-02-05T17:36:42","date_gmt":"2026-02-05T16:36:42","guid":{"rendered":"https:\/\/cloix-mendesgil.com\/non-classe\/the-transport-regulatory-authoritys-first-decision-concerning-a-service-facility-operated-by-a-new-entrant\/"},"modified":"2026-02-05T17:36:42","modified_gmt":"2026-02-05T16:36:42","slug":"the-transport-regulatory-authoritys-first-decision-concerning-a-service-facility-operated-by-a-new-entrant","status":"publish","type":"post","link":"https:\/\/cloix-mendesgil.com\/en\/railway-reform-blog\/the-transport-regulatory-authoritys-first-decision-concerning-a-service-facility-operated-by-a-new-entrant\/","title":{"rendered":"The Transport Regulatory Authority\u2019s first decision concerning a service facility operated by a new entrant"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In an opinion dated 18 December 2025 (No. 2025-100), the Transport Regulatory Authority ruled on the setting of charges relating to regulated services provided by Transdev Rail Sud Inter-metropoles at the service facilities of maintenance centers for the 2025 and 2026 timetables.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Authority provided guidance on the regime governing access to service facilities. The notice is particularly unprecedented in that the operator of the service facility is a new entrant: Transdev\u2019s subsidiary, Transdev Rail Sud Inter-M\u00e9tropoles (TRSI), a company dedicated to operating the Marseille\u2013Toulon\u2013Nice section of the Region Sud network.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Authority explains the background. Soci\u00e9t\u00e9 TRSI has been operating two maintenance sites since 29 June 2025: Nice-Ville and Marseille-Pautrier. The Nice-Ville maintenance center has undergone major works funded by the Region. The Authority does not specify which entity owns the facilities, a matter of no consequence under Article 1 of Decree No. 2012-70 of 20 January 2012 on service facilities (Decree on railway network service facilities).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Authority notes that requests for access to the facilities come from companies operating services under contract for the Provence-Alpes-C\u00f4te d\u2019Azur Region; requests from railway undertakings operating non-contracted services are marginal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The opinion provides the following insights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Firstly, regarding the definition of a service facility, the Authority reiterates the definition set out in Article 1 of the Decree on Service facilities. According to this Decree, a service facility is characterized by three elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A facility referred to in Article 1 of the Decree (such as passenger stations, freight terminals and sidings), including buildings, land and equipment,<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The facility is subject to special development,<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The purpose of this special development is to enable the provision of services referred to in the Decree:<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Basic services which are not ancillary or related services<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ancillary services referred to in Annex II, point 3, of Directive 2012\/34\/EU of the European Parliament and of the Council of 21 November 2012 (the list is not exhaustive: traction power, pre-heating of carriages, control of the transport of dangerous goods, assistance with the movement of special trains)<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Secondly, the existence of a service facility entails an obligation to provide access to railway undertakings on fair, non-discriminatory and transparent terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thirdly, the rules on access are specifically laid down in European legislation, namely Commission Implementing Regulation No 2017\/2177 of 22 November 2017. This Regulation thus requires:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To draw up a detailed description of service facilities and associated services (Article 4)<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To publish this information (Article 5)<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Apply allocation principles and rules (Articles 7, 8, 9, 10, 12 and 13: cooperation, responses and response times, priority criteria, viable alternatives, refusal of access), for unused service facilities (Article 15)<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Access pricing and the services offered are regulated<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Fourthly, the Authority rules on the method for determining access tariffs. It holds that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>TRSI may determine the cost bases by relying primarily on data set out in the public service contract signed with the Sud-PACA region and assessed over a ten-year period, discounting them at the rate specified in the contract<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>TRSI may base its calculations on average costs over ten years, corresponding to the total duration of the public service contract, rather than those projected solely for the years 2025 and 2026, to reduce the impact on the early years<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For services involving access to facilities, TRSI uses the following assumptions, depending on the nature of the facilities: (I) either the maximum utilization capacity of the facilities at the sites, or (II) the projected utilization of the facilities, including those of third-party railway undertakings<\/li>\n\n\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For services requiring the deployment of TRSI staff, the estimate of the number of productive staff hours is based on the data set out in the public service contract signed with the Region<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The opinion thus issued is particularly informative and addresses an unprecedented situation arising from the opening up of passenger rail transport to competition.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In an opinion dated 18 December 2025 (No. 2025-100), the Transport Regulatory Authority ruled on the setting of charges relating [&hellip;]<\/p>\n","protected":false},"author":0,"featured_media":8807,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[15,51],"tags":[],"class_list":["post-9469","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-mobilaw","category-railway-reform-blog"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.8 -
